Complaint Process (81400-JA-¶362.2)
Amend ¶362.2 as follows:
¶ 362.2 Administrative Complaint– If the bishop determines that the complaint is based on allegations of incompetence, ineffectiveness, or unwillingness or inability to perform ministerial duties,
he or she the bishop shall refer the complaint as an administrative complaint to the board of ordained ministry for its consideration of remedial or other action. However, if the complaint is based on allegations of one or more of the offenses listed in ¶ 2702 the bishop shall refer the complaint as a Judicial Complaint notwithstanding that such referral may consequently require that additional judicial procedures be followed and a church trial.
The Administrative Complaint process, although a helpful process in the appropriate case, has unfortunately been misused and abused by certain bishops to avoid having to refer a Judicial Complaint and the attendant possible later requirements of a church trial.
